| Electric
bicycles and scooters are legal on the roads of many
provinces in Canada, provided they comply with certain
federal and provincial regulations. Among these provinces
are British Columbia and Quebec, and since October,
2006, Ontario. Each province or territory in Canada
regulates the use of electric vehicles. For some provinces,
the regulating body is the Provincial Motor Vehicle
Branch or the major Insurance Company.
In British Columbia, ICBC is the institution
which specifies the description and conditions under
which electric bicycles and scooters can be used. These
vehicles are classified as Motor Assisted Cycles (MAC)
and to be used on the road, they must comply with the
ICBC
regulations . These regulations are summarized in
the ICBC
press release when the amendment was enacted in
BC.
Transport Canada is the federal institution enforcing
Canada Motor Vehicle Safety Act (CMVSA) which specifies
what type of electric two and three wheelers are compliant
with this act and officially permitted for import. The
legal vehicles are classified as Power Assisted Cycles
according to section
1.2.1 of MVSA . All other motorized means of transportation,
with few exceptions which do not comply with this section,
are considered motor vehicles and must comply with the
corresponding section of the CMVSA.
All vehicles that do not comply with Transport Canada
Regulations are not permitted in Canada and, consequently
are illegal for sale. E-RIDE DOES NOT SELL any non-compliant
(with CMVSA and ICBC regulations) electric scooters
or electric bicycles.
ANY NON-COMPLIANT TWO OR THREE
WHEEL ELECTRIC VEHICLE, USED ON CANADIAN ROADS IS SUBJECTED
TO FINE FOR DRIVING A MOTOR VEHICLE WITH NO INSURANCE
UNDER THE SECTION OF THE CANADIAN MOTOR VEHICLE ACT
How to avoid a ticket
of more than $700.00 for riding an electric bicycle
or electric scooter.
There are three main reasons a ticket may be issued
when riding an electric scooter or electric bicycle
on the roads in Canada
1. The police officer is not familiar with
the particular province regulations.
The new amendment
in the motor vehicle act and BC
regulations for the road use of electric scooters
and electric bicycles became effective in the beginning
of year 2003. During the first two years, some of our
customers were erroneously fined for riding electric
scooter without insurance. After the scooters they purchased
from E-Ride have been presented for inspections their
tickets were cancelled. Since the use of electric scooters
in the cities is becoming a trend, the majority of the
road regulations enforcement police officers are now
familiar with all the necessary features for the road
use compliance. If any of our customers receives a ticket
for using a MOTORINO ST, XT or XP scooter, purchased
from E-Ride, provided it hasn not been modified, we
guarantee that we will pay his ticket if not cancelled.
2. The electric
bicycle or scooter is modified by the rider in a way
which does not comply with the regulations.
The electric scooters and bicycles we sell are compliant
with all federal and provincial regulations, as we sell
them and advise our customers to use them. However if
an electric scooter or bicycle is modified by a customer
(e.g. increasing the speed, power or modification of
other safety features specified by Transport Canada),
we cannot be responsible for the issued ticket. The
most common example is using an electric scooter whose
pedals have been removed or folded.
3. The electric
scooter or bicycle is not compliant with CMVSA or provincial
regulations.
The legality issue for the use of electric scooters
and bicycles differ in many countries. Most of the compliance
criteria for Canada are specific and this makes many
imported electric scooters and bicycles non-compliant
on the roads in Canada. Our MOTORINO electric scooters
and electric bicycles are designed exclusively for the
Canadian market and are compliant in all Canadian provinces,

1.2.1 of MVSA
